How to apply for a portable document A1 (PD A1) in case of posting (employee, SEP) or in the case of simultaneous pursuance of activity (employee/SEP/SZČO) on the territory of two or more EU Member States, EEA, Switzerland and the United Kingdom of Great Britain and Northern Ireland? Details can be found in this section. You will speed up the processing of the PD A1 if you request the document electronically.

Posting of an employee

If an employee who usually performs activities for an employer in the territory of the Slovak Republic is temporarily sent by this employer to the territory of another Member State of the EU, EEA, Switzerland or the United Kingdom of Great Britain and Northern Ireland (receiving state) to perform work there for the given employer, continues to be subject to the legislation of the Slovak Republic under the conditions that the expected duration of this work does not exceed 24 months and that he is not sent to replace another posted person.

The sending employer, as well as the posted employee, must meet the conditions of posting in accordance with the applicable legislation (e.g. turnover achieved in the Slovak Republic, etc.) - see information about posting here: Work in the EU, EEA, Switzerland and the United Kingdom of Great Britain and Northern Ireland Britain and Northern Ireland.

In order to apply for posting of an employee to the territory of another Member State of the EU, EEA, Switzerland or the United Kingdom of Great Britain and Northern Ireland, it is necessary to apply via the Social Insurance Agency.

The completed paper form must be printed, signed and sent or personally delivered to the relevant branch of the Social Insurance Agency, which administers the employer in the employers' register, in sufficient time before the start of the posting.

The relevant branch of the Social Insurance Agency will issue the portable document A1

In the event that all the posting conditions are met, the relevant branch of the Social Insurance Agency will issue the portable document A1 no later than 45 days from the date of delivery of the application and send it to the employer/employee.

The branch of the Social Insurance Agency issues a portable document A1 for the purpose of posting of an employee free of charge for a maximum period of 24 months.

It is necessary for the employee to have a portable A1 document with them

when carrying out activities in Member States of the EU, EEA, Switzerland or Great Britain (in the event that a foreign employer, the control and inspection authorities of the given state require its submission, if the employee suffers a work-related injury, etc.)

The A1 portable document does not need to be translated into another language

because the uniform format (with regard to the language of the given Member State) is used by all countries of the EU, EEA, Switzerland and Great Britain.

The employer and the employee notify the relevant branch of the Social Insurance Agency in writing of changes that occur during the posting period.

Posting of SEP/ SZČO

Text

A person who usually works as a self-employed person (SEP) in the territory of the Slovak Republic and pursues a similar activity in the territory of another Member State of the EU, the EEA, Switzerland or the United Kingdom of Great Britain and Northern Ireland continues to be subject to the legislation of the Slovak Republic under the condition, that the expected duration of this work will not exceed 24 months.

A self-employed person must meet the posting conditions in accordance with the applicable legislation (e.g. the existence of operating premises, etc.) - see information about posting here: Work in the EU, EEA, Switzerland and the United Kingdom of Great Britain and Northern Ireland.

Applying for the institution of posting of a self-employed person to the territory of another Member State of the EU, EEA, Switzerland or the United Kingdom of Great Britain and Northern Ireland must be applied via the Social Insurance Agency.

in sufficient time before the start of the posting.

In the event that all the conditions of posting by the SEP/SZČO are met, the relevant branch of the Social Insurance Agency will issue the portable document A1 no later than 45 days from the date of delivery of the application and send it to the SEP/SZČO. Posting of a civil servant

Text

A civil servant is subject to the legislation of the Member State whose administration employs them.

In the event that an employee performs activities for the state administration of the Slovak Republic and is posted to perform work in the territory of another Member State of the EU, EEA, Switzerland or the United Kingdom of Great Britain and Northern Ireland, it is necessary to request the Social Insurance Agency to issue PD A1 due to the posting.

The completed paper form must be printed, signed and sent or personally delivered to the relevant Social Insurance Agency, which administers the employer in the employers' register, in sufficient time before the start of the civil servant’s work in the territory of another Member State.

The relevant branch of the Social Insurance Agency will issue the portable document A1

In case all the conditions are met, the relevant branch of the Social Insurance Agency will issue the portable document A1 no later than seven working days from the date of delivery of the application and send it to the employer/civil servant. The relevant branch of the Social Insurance Agency issues the portable document A1 for the purpose of performing the work of a civil servant in the territory of another Member State free of charge.

Simultaneous pursuance of the employee's activities in the territory of several EU countries

Text

If a person usually carries out activities as an employee in two or more Member States of the EU, the EEA, Switzerland and the United Kingdom of Great Britain and Northern Ireland, it is necessary to determine the applicable legislation in accordance with the regulation of the European Parliament and the Council no. 883/2004 on the coordination of social security systems (regulation), since according to the regulation, an employee can be subject to the social security legislation of one Member State of the European Union (EU) at the same time.

The Social Insurance Agency determines the applicable legislation in the case of employees residing in the territory of the Slovak Republic.

In case of simultaneous pursuance of the employee's activities in the territory of two or more Member States of the EU, EEA, Switzerland and the United Kingdom of Great Britain and Northern Ireland, it is necessary to request the Social Insurance Agency to determine the applicable legislation.

The application is submitted to the relevant branch of the Social Insurance Agency, which registers it, checks it and, if it is incomplete, completes the necessary data (in cooperation with the employee). After completion, the relevant Social Insurance Agency branch will forward the application to the Social Insurance Agency headquarters for processing.

Relevant documents (or scans) proving the facts stated in the application must be attached to the application in sufficient time before the start of the posting.

In case of simultaneous pursuance of activities, if the residence of the employee (specified in point 2 of the application) is located in the territory of a Member State other than the Slovak Republic

the headquarters of the Social Insurance Agency will forward the request to the relevant institution of the Member State of residence, as it is not competent to act in this matter, except in the case that to the application is attached a determination of the Slovak legislation issued by the institution of the state of residence.

If the Slovak legislation applies to the employee, the headquarters of the Social Insurance Agency will issue a portable document A1

based on the assessment of the application within 60 days at the latest from the delivery of the application to the headquarters and sends it to the employee at the address indicated in the application. If the result of the determination of the applicable legislation is the determination of the legislation of another Member State of the EU, the EEA, Switzerland and the United Kingdom of Great Britain and Northern Ireland, the Social Insurance Agency will notify this fact to the relevant institution of the Member State whose legislation is determined, through the EESSI system (Electronic Social Security Data Exchange), that the relevant institution issues the PD A1 with the legislation of the given state to the employee.

The headquarters of the Social Insurance Agency issues the transferable document A1 due to the simultaneous pursuance of the employee's activity, depending on the situation, free of charge for a maximum period of 24 months from the date of delivery of the application (if the simultaneous pursuance of the activity began in the past, the situation is assessed retrospectively as well).

It is necessary for the employee to have a portable A1 document with them

Simultaneous pursuance of SEP/SZČO activities on the territory of several EU countries

Text

If the SEP/SZČO usually carries out activities in two or more Member States of the EU, the EEA, Switzerland and the United Kingdom of Great Britain and Northern Ireland, it is necessary to determine the applicable legislation in accordance with Regulation of the European Parliament and the Council no. 883/2004 on the coordination of social security systems (regulation), since according to the regulation, SEP/SZČO can be subject at the same time exclusively to the legislation of one Member State of the European Union (EU) in the field of social security.

The Social Insurance Agency determines the applicable legislation in the case of SEP/SZČO residing in the territory of the Slovak Republic.

After completion, the relevant Social Insurance Agency branch will forward the application to the Social Insurance Agency headquarters for processing.

the headquarters of the Social Insurance Agency will forward the request to the relevant institution of the Member State of residence, as it is not competent to act in this matter, except in the case that to the application is attached a determination of the Slovak legislation by the institution of the State of residence.

If Slovak legislation applies to SEP/SZČO, the headquarters of the Social Insurance Agency will issue a portable document A1

If a person usually performs activities as an employed person and activities as SEP/SZČO in different Member States of the EU, EEA, Switzerland and the United Kingdom of Great Britain and Northern Ireland, it is necessary to determine the applicable legislation in accordance with Regulation of the European Parliament and Council No. 883/2004 on the coordination of social security systems (regulation), since according to the regulation, an employee/SEP/SZČO can be subject at the same time exclusively to the legislation of one member state of the European Union (EU) in the field of social security.

Social Insurance Agency determines the applicable legislation in the case of an employee/SEP residing in the territory of the Slovak Republic.

Simultaneous pursuance of activities as a civil servant and as an employee and/or SEP/SZČO in different EU countries

Text

If a person usually performs activities as a civil servant and activities as an employee and/or SEP/SZČO in different Member States of the EU, EEA, Switzerland and the United Kingdom of Great Britain and Northern Ireland, it is necessary to determine the applicable legislation in accordance with Regulation of the European Parliament and Council No. 883/2004 on the coordination of social security systems (regulation), since according to the regulation, a civil servant/employee/SEP/SZČO can be subject at the same time exclusively to the legislation of one member state of the European Union (EU) in the field of social security.

The Social Insurance Office determines the applicable legislation in the case of a civil servant/employee/SEP/SZČO residing in the territory of the Slovak Republic.

Application for the issuance of a portable document A1 to a person who pursues activities as an employee or as a SEP in the Slovak Republic

In the event that a person is employed or self-employed in the Slovak Republic, subject to the legislation of the Slovak Republic and for this reason wants to be exempted from the social security system of another Member State (e.g. from the social security system of the State of residence), while participation in the social security system of another Member State of the EU, EEA, Switzerland and the United Kingdom of Great Britain and Northern Ireland did not commence, or does not last for the employee or SEP due to the performance of a gainful activity, it is necessary to request the Social Insurance Agency to issue a PD A1.

Application for the issuance of a portable document A1 due to the granting of an exemption

In the event that a person has been granted an exception, on the basis of which the legal regulations of the Slovak Republic apply to the person, they can request the Social Insurance Agency to issue a PD A1.

Please note that if a person has been granted an exemption stating that they are subject to the legislation of two or more EU Member States, the EEA, Switzerland and the United Kingdom of Great Britain and Northern Ireland, a PD A1 is not required to be issued - see information in the posting section here: Work in the EU, EEA, Switzerland and the United Kingdom of Great Britain and Northern Ireland.

The Social Insurance Agency will issue PD A1 based on the notification of exemption from the Ministry of Labour, Social Affairs and Family of the Slovak Republic

To a person who has been granted an exemption, on the basis of which the legislation of the Slovak Republic apply to that person, the relevant branch of the Social Insurance Agency will issue a portable document A1 on the basis of the notification on the granting of the exemption, which was delivered to the Social Insurance Agency by the Ministry of Labour, Social Affairs and Family (MPSVR SR), within seven working days from the date of delivery of the said notification.

In the event that the exemption notification does not contain all the necessary information

for the issuance of a portable document A1, then the relevant branch of the Social Insurance Agency will invite the client within seven working days from the date of delivery of the notification to submit an application for the issuance of PD A1 due to the granted exemption.

The completed application must be printed, signed and sent or personally delivered to the relevant branch of the Social Insurance Agency.

The relevant branch of the Social Insurance Agency will issue the transferable document A1 within seven working days from the date of delivery of the aforementioned application and send it to the applicant.

The relevant branch of the Social Insurance Agency issues the portable document A1 for the purpose of the employee's/SEP's/SZČO work in the territory of another Member State free of charge.

The A1 portable document does not need to be translated into another language because the uniform format (with regard to the state language of the given Member State) is used by all Member States of the EU, EEA, Switzerland and the United Kingdom of Great Britain and Northern Ireland.
