Am I a state insured person, do I have to apply to the Social Insurance Agency?

You must submit an application to the Social Insurance Agency only if you are:

  • a natural person caring for a child under six years of age, if you are not entitled to parental allowance from the Office of Labour, Social Affairs; and Family); and
  • a natural person who, according to a contract, provides personal assistance to a person with a disability for at least 140 hours per month, while the person with a disability to whom personal assistance is provided is not entitled to a cash allowance for personal assistance (contract not registered with the Labour Office).

Application Procedure

To apply to the Social Insurance Agency as a state insured person, follow these steps:

Fill in the necessary forms

Fill in the form Natural person registration sheet – application form of a state insured person and, if you are a natural person caring for a child under 6 years of age, also the Declaration of a natural person for the purposes of pension insurance based on duly child care, confirming that you are properly caring for the child for the purposes of pension insurance.

The forms are also available at the branches of the Social Insurance Agency.

Filing a Deregistration

When should I file a deregistration from the Social Insurance Agency as a state insured person?

You are OBLIGATED to file a deregistration if you are:

  • a natural person caring for a child under six years of age; or

  • a natural person caring for a child with a long-term adverse health condition under 18 years of age

    and you cease to provide the proper care.. You are obliged to file a deregistration from pension insurance within eight days of the end of proper care. The end of proper care for a child is considered, for example, if another person (e.g. the father) starts to care for the child or the child has been entrusted to the care of another person.

    Note: The end of receiving parental allowance or the placement of a child in kindergarten is not considered the end of proper care for a child. If, for example, a mother takes care of a child even after the end of receiving parental allowance, her state insured person insurance continues. She therefore does not file a deregistration because she continues to properly care for the child under six years of age.

  • a natural person providing personal assistance to a person with a disability for at least 140 hours per month, who has applied for pension insurance due to the provision of this personal assistance, within eight days from the date from which, according to the contract on the provision of personal assistance, personal assistance is to be provided in an amount of less than 140 hours per month, or from the date of termination of the contract on the provision of personal assistance.

YOU HAVE THE OPTION to deregister if:

as a state insured person, for any reason you are not interested in being pension insured. Your pension insurance as a state insured person will cease to exist from the date of deregistration, but no earlier than the date of deregistration.

IMPORTANT INFORMATION: If, after deregistration, you decide that you want to be a state insured person again, you can apply and your insurance will be established from the date specified in the application, but no earlier than the day following your deregistration from pension insurance as a state insured person. Of course, this only applies if you meet the conditions for being insured by the state.

Termination of pension insurance of a state insured person

Termination of pension insurance of a state insured person:

  • A natural person pension-insured as an employee or self-employed person during the period in which maternity leave is provided to him/her – compulsory pension insurance terminates on the date of termination of maternity leave.
  • A natural person caring for a child under six years of age – compulsory pension insurance terminates on the date of termination of proper care for this child, no later than the date of reaching the age of six.
  • A natural person caring for a child with a long-term adverse health condition up to 18 years of age – compulsory pension insurance terminates on the date of termination of proper care for this child, no later than the date of reaching the age of 18.
  • A natural person receiving a care allowance – compulsory pension insurance terminates on the date of termination of the provision of a cash allowance for care.
  • A natural person providing personal assistance to a person with ŤZP - mandatory pension insurance expires on the day from which, according to the contract on the performance of personal assistance, personal assistance is to be performed in the amount of less than 140 hours per month or on the day of termination of the contract on the performance of personal assistance.
  • Soldier in voluntary military training according to a special regulation - mandatory pension insurance expires on the day from which he no longer performs voluntary military training or upon granting a disability pension.
  • A natural person who is granted a compensatory allowance – mandatory pension insurance ceases on the date of termination of the entitlement to a compensatory allowance.

For all groups of state insured persons, their mandatory pension insurance also ceases on the date on which the person no longer meets at least one of the legally imposed conditions for the possibility of being pension insured as a state insured person.

What are my obligations towards the Social Insurance Agency?

To assess the termination of pension insurance, it is necessary for you, as a state insured person, to immediately notify the branch of the Social Insurance Agency competent according to your place of permanent residence if:

  • you have a residence (according to EU coordination regulations, a residence is the place where a person usually stays, where he has family, property, and the centre of his vital interests) in the territory of another Member State of the European Union, a state of the European Economic Area, the Swiss Confederation or the United Kingdom of Great Britain and Northern Ireland (hereinafter referred to as the "EU Member State");
  • you are compulsorily insured in another EU Member State;
  • you are covered by an international agreement on social security matters that takes precedence over the laws of the Slovak Republic;
  • you have been granted an early retirement pension or disability pension in another EU Member State or in a state with which the Slovak Republic has concluded an international agreement on social security;
  • you lose your permanent residence in the territory of the Slovak Republic or in the territory of another Member State EU;
  • Act No. 328/2002 Coll. on social security of police officers and soldiers and on amendments and supplements to certain acts, as amended, applies or will apply to you.
