When is a natural person receiving a care allowance and a natural person providing personal assistance compulsorily pension insured?

If you are a natural person who is provided with a cash allowance for care, or a natural person who, according to a contract on the provision of personal assistance, is to provide personal assistance to a natural person with a disability for at least 140 hours per month, you are compulsorily pension insured if you meet the following conditions:

  • you have permanent residence in the Slovak Republic;
  • you are not pension insured as a natural person who is properly caring for a child under six years of age or a child with a long-term adverse health condition under 18 years of age;
  • you are not granted an early old-age pension or disability pension,
  • you have not reached your retirement age;
  • you have applied for pension insurance due to the provision of personal assistance, if you are a natural person who, according to a contract on the provision of personal assistance, is to provide personal assistance to a natural person with a disability for at least 140 hours per month, while the person with a disability to whom personal assistance is provided is not entitled to a cash allowance for personal assistance (submission of an application for pension insurance due to the performance of personal assistance is not required if you are a natural person who, according to a contract on the performance of personal assistance, is to provide personal assistance to a natural person with a disability for at least 140 hours per month, while the person with the disability to whom personal assistance is provided is entitled to a cash allowance for personal assistance).

IMPORTANT INFORMATION: All of the above conditions must be met simultaneously. If you do not meet one of the above conditions at a certain time, you do not belong to the group of persons who are compulsorily insured for pension insurance and compulsory pension insurance will not arise for you and, if it has already arisen, it will cease by law.

A natural person providing personal assistance to a disabled person who has applied for pension insurance is obliged to deregister from pension insurance within eight days from the date on which, according to the contract on the provision of personal assistance, personal assistance is to be provided in an amount of less than 140 hours per month, or from the date of termination of the contract on the provision of personal assistance in the branch competent for the place of permanent residence.
